TERMS AND CONDITIONS OF PURCHASE

These terms and conditions of purchase constitute the agreement between you as a consumer (“you”) and WallRibbon (“WallRibbon”), corporate identification no. 556120-7837, with address Vittarydsverken, Sture Steens Väg 9, 341 55 Vittaryd, e-mail: info@wallribbon.com, when you order products from www.wallribbon.eu (“the Website”).

  1. GENERAL

1.1 To complete an order on the website, you must confirm that you are over 18 years of age. WallRibbon agrees, in accordance with Swedish law, not to accept credit card payments from persons under the age of 18. WallRibbon reserves the right, in individual cases, to refuse or modify your order (e.g. if WallRibbon suspects fraud, if you have provided false personal information, and/or if there is default on payment of a debt). The website and all its content are owned by WallRibbon or its licensees. The content is protected under intellectual property and marketing laws. This means that trademarks, trade names, product names, images, graphics, design, layout and information products, services and other content may not be copied or used without WallRibbon’s written consent.

1.2 You declare that all of the information you have provided is correct.

  1. ORDERING AND ACCEPTANCE OF TERMS AND CONDITIONS OF PURCHASE

2.1 By clicking “I accept the terms and conditions of purchase” at the WallRibbon digital checkout (“Checkout”), you accept these terms and conditions of purchase for ordering our products. You confirm the order of the products you have placed in the shopping basket by clicking the “Confirm purchase” button.

2.2 WallRibbon will only approve your order once payment has been made and approved by the card payment company, or once Billmate/Klarna AB (“Klarna”, “Billmate”) has approved your credit. WallRibbon reserves the right not always to offer all payment methods.

2.3 After you have confirmed the purchase, WallRibbon will send an order confirmation with the details of the purchase to the e-mail address you provided at checkout. Please note that it is therefore important that you enter the correct information when placing an order. WallRibbon recommends that you save the order confirmation in order to facilitate any contact with our customer support service. The order confirmation is also your proof that you have completed your purchase. If you have not received an order confirmation within 24 hours, please contact the WallRibbon customer support service, info@wallribbon.com, to confirm your purchase.

  1. PERSONAL DATA

3.1 Your privacy and security are important to WallRibbon. When you shop on the website, we store some of your personal information to enable you to complete your purchase. You have the right to request access to the information we hold about you, and if any information is inaccurate you can have it rectified or erased. WallRibbon may also use cookies to improve your user experience on the website. For more information about how we process personal data and cookies, please read our privacy policy.

  1. WALLRIBBON PRODUCTS

4.1 WallRibbon sells and manufactures to order: wall panels, ribbed panels and accessory items with the characteristics and to the extent indicated in the product description available on the website. All images on the website are for illustrative purposes only. Such illustrations are not guaranteed to be exact representations of the appearance, function or origin of the product you will receive. WallRibbon also manufactures products such as wood veneers, painted strips etc. from natural materials that may change appearance and/or develop a patina over time due to oxidation and/or normal use. This is a natural process that occurs in natural materials and not a reason for complaint. WallRibbon will, to the extent possible, inform you of this in its product descriptions. If you feel that you have insufficient information, we recommend that you contact our customer support service before proceeding with your purchase.

  1. PRICES

5.1 All prices for products listed on the website are shown in the currency of your choice and, where applicable, including the VAT rate for the country to which the receipt is issued within the EU. VAT is not included in our prices for customers outside the EU. Orders to countries outside the EU may be subject to local VAT, import duties and/or taxes that are levied when your package reaches your country. You are responsible for the payment of such import duties and taxes. WallRibbon has no control over these fees, and since these fees are different for different countries, WallRibbon cannot predict these costs. Contact your local customs office for more information. The price does not include payment method charges and shipping costs, which are added separately.

5.2 WallRibbon reserves the right to change the prices on the website at any time and to correct the prices after any errors have occurred.

5.3 Prices may vary depending on the country you are ordering from. The final price of products is displayed at the checkout.

5.4 The price for shipping products depends on the size, weight and destination of the products. The total price of products and shipping is displayed at the checkout.

5.5 Please note that changing the country of delivery may affect the cost of shipping.

  1. PAYMENT

6.1 WallRibbon uses a third-party provider for processing payments. Once you have clicked on “Confirm Purchase”, your payment will be processed by our third-party payment service provider, where you will be able to complete your payment. By selecting a payment method, you acknowledge that you understand and agree that WallRibbon’s third-party payment service provider will be used for your payment. You will find these conditions at the checkout before you place your order.

6.2 You understand that the terms and conditions of the relevant third-party payment solution provider apply in full to your payment to WallRibbon, and you agree to this. WallRibbon cannot be held responsible for any problem with payment that may arise. In such a case, you should contact the relevant payment provider.

6.3 WallRibbon reserves the right to refuse an order if payment by invoice, or another payment method chosen by you, is not accepted. WallRibbon reserves the right not always to offer all payment methods, as well as to change the payment method if for any reason your choice of payment does not work at the time of purchase.

6.4 WallRibbon does not store or process on the Website any bank or credit card numbers, or any other information you supply to the payment provider.

6.5 WallRibbon reserves the right to cancel a purchase if fraud is suspected.

  1. TERMS AND CONDITIONS OF DELIVERY

7.1 We offer different shipping methods and delivery terms depending on the product, the weight of the goods to be shipped, and where you are located in the world. The choices you can make will be displayed at the checkout when you pay.

7.2 Mode of shipping – Postal collection point or shipping company terminal

7.2.1 WallRibbon offers you the opportunity to collect samples, glue, oil and screws from your postal collection point or the shipping company’s terminal. This postal collection point may be a food and tobacco shop. Please note that when your order includes panels, mouldings or LED lighting, you will usually be offered home delivery. In some cases the shipping company’s terminal may also be offered as a delivery point depending on order size and country of delivery.

7.2.2 Should products not be collected, they will be returned to WallRibbon. For uncollected products, WallRibbon will charge you for the costs incurred in connection with the return. These costs consist of return shipping and the cost of storing products in a warehouse before they can be returned. This storage cost is 295 SEK/day for larger orders delivered on pallets or equivalent load carriers. For smaller shipments, the storage cost is 30 SEK/day/package (this may apply to e.g. small items such as samples and screws). If you have more than one package, the cost will therefore be higher than 30SEK/day.

7.3 Shipping methods – Home delivery

7.3.1 WallRibbon offers you the opportunity to have your order delivered to your home. This means up to your gateway if you live in a flat, and up to your property line if you live in a house. “Up to” means as close to your gateway or property line as a lorry can approach.

7.4 Delivery times

7.4.1 Products kept in stock such as ribbed panels, wall panels, samples, finishing strips, screws, adhesives and LED lighting are shipped within 2-7 working days.

7.4.2 For products made to order, such as sawn ribbed panels and wall panels at height, approximately 2 working days are added.

7.4.3 Some products indicate a delivery time of 5-6 weeks as specified on the website.

7.4.4 Unforeseen problems or delays in the manufacture of your products may affect your delivery time. In addition, holiday periods may cause longer delivery times than those indicated on the website. WallRibbon will do its best to inform you of this, as well as to keep you informed of any delays affecting your delivery.

7.4.5 If products in stock and products made to order are part of the same order, the longer delivery time will apply.

7.4.6 The delivery time for your products should always be regarded as an estimate indicating when your order will be delivered from the factory. WallRibbon cannot give you an exact delivery date for your order.

7.4.7 Please note that changing the country of delivery may affect the estimated delivery time.

7.5 Transport damage

7.5.1 Upon receipt of your delivery from WallRibbon, you, the customer, must promptly examine and check whether the packaging and/or the product is damaged. If any transport damage to the packaging and/or the product is detected, this must be noted on the supplier’s/delivery point’s transport document/slip.

7.5.2 In the case of home delivery, any transport damage to the packaging and/or the product must be noted on the transport document/slip before the supplier leaves the site.

7.5.3 Any damage caused in transit to the packaging or product must be documented by photographs of the product with and without its packaging, and communicated to the supplier within 5 days of delivery.

7.5.4 WallRibbon’s liability to you for any loss or damage arising in connection with your order on the website is limited to the total amount of your order. WallRibbon is not liable for indirect losses.

7.6 Customer’s ability to pay

7.6.1 Should WallRibbon have reason to doubt your ability to pay, WallRibbon reserves the right to stop the delivery and has no obligation to carry out the delivery until full payment of the order has been received by WallRibbon, or until an alternative agreement has been reached.

  1. COMPLAINTS

8.1 If you wish to complain about a product due to a defect, please notify us by e-mail: info@wallribbon.com.

8.2 In the event of a complaint, the purchaser is responsible for all return shipping costs. Before sending the product, make sure that your case has been received and approved by WallRibbon’s customer support service.

8.3 In the event of a return shipment due to a complaint, you are responsible for packing the product so that it is not damaged during transport.

  1. DELAYS

9.1 If the delivery time is later than that initially indicated, WallRibbon will not pay compensation for any loss of earnings or compensation for any external installation assistance that is employed. WallRibbon does not accept any liability for any damage caused by a delivery’s taking longer than the stated time.

  1. RIGHT OF WITHDRAWAL

10.1 Consumers in the EU and EEA have a 14-day period in which to exercise their right of withdrawal regarding goods purchased online. This period runs from the day the goods are delivered to the customer. This means that you, the customer, must notify WallRibbon that you are cancelling your purchase within 14 days from the date you received delivery of the goods. You can do this by emailing us at info@wallribbon.com and clearly stating that you are cancelling your purchase, or by using the standard document for exercising the right of withdrawal drawn up by the Swedish Consumer Agency, click here.

Please note that WallRibbon will only refund you for the products purchased, not for any costs related to shipping, transportation and/or payment method charges or other charges. Please note that this right of withdrawal only applies to consumers and to purchases from the regular range. This means that the right of withdrawal does not apply to the purchase of a product manufactured to a customer’s unique specification, e.g. to an order with saw cuts or product samples.

10.2 In the event of exercise of the right of withdrawal, the purchase price will be refunded as soon as possible, but no later than 14 days after WallRibbon has received your notification of withdrawal. WallRibbon may withhold payment until we have received the goods or you have proven that the goods have been returned to us. Refunds will be made to the source of the original purchase, unless otherwise agreed or unless a problem arises.

10.3 In the case of a return, the purchaser is obliged to compensate WallRibbon for any depreciation in value caused by the examination of the product, if the examination was more extensive than necessary. However, the purchaser is entitled to check the condition of the product upon delivery.

10.4 The purchaser is responsible for all return shipping costs when exercising the right of withdrawal.

Matters to consider: Please note that if you exercise your right of withdrawal, the return shipping costs are likely to be more expensive than the shipping costs you paid to receive the goods. This is because purchasing shipping services singly is significantly more expensive than purchasing shipping services in bulk. Should damage occur during such a return shipment, you should claim compensation from the shipping company you use. You should therefore familiarise yourself with the insurance terms of the shipping company you use so that you know you will be fully compensated in the event of damage.

As all our orders are unique, we are unable to provide a schedule of return costs. If you have any questions regarding the possible cost of return shipping, please contact the WallRibbon customer support service, info@wallribbon.com, who will do their best to provide you with an estimated cost of return shipping.

10.5 The purchaser is responsible for returning the product in faultless condition. The product must be returned well packaged in the same packaging in which it was delivered or in equivalent packaging (maximum one package). In the event of a return shipment due to the exercise of your right of withdrawal, you are responsible for packing the product so that it is not damaged during transport.

10.6 WallRibbon reserves the right to refuse a return if any of the above conditions are not met.

  1. GUARANTEE

11.1 5-year warranty on material and manufacturing defects.

11.2 WallRibbon always strives to deliver the highest quality but makes no guarantees that the quality, suitability or use of the products will meet your expectations.

11.3 WallRibbon’s products are WallRibbon’s responsibility until they reach the delivery address.

  1. LIMITATION OF LIABILITY

12.1 WallRibbon shall not be liable for any damage caused or any costs incurred in connection with the installation and use of WallRibbon’s products.

12.2 WallRibbon shall not be liable for any damage caused or any costs incurred as a result of typographic errors or outdated information on the Website.

12.3 With further reference to Section 6, you acknowledge and understand that the terms and conditions of the relevant third-party payment solution provider apply in full to your payment to WallRibbon. WallRibbon cannot be held responsible for any problem with payment that may arise. In such a case, you should contact the relevant payment provider.

  1. FORCE MAJEURE

13.1 In the event of war, strike, riot, disaster, steep price changes on the global market, failure of electrical communications, telecommunications, data connections or other communications, defective delivery or non-delivery of goods by subcontractors, and comparable events that are beyond WallRibbon’s control and ability to predict, WallRibbon shall be released from its obligations to fulfil these purchase conditions due to force majeure. If this happens, WallRibbon will attempt to notify you.

  1. APPLICABLE LAW AND DISPUTE RESOLUTION

14.1 These terms and conditions shall be governed by and interpreted in accordance with Swedish law. To the fullest extent permitted by law, disputes arising as a result of or in connection with these terms and conditions or your use of the service shall be governed by Swedish law and be resolved by the Swedish courts, except in cases where WallRibbon voluntarily chooses to take legal action against the customer or user where the customer or user is domiciled.

14.2 Any disputes concerning the establishment, interpretation or application of these terms and conditions or other relationships between you the customer and WallRibbon shall ultimately be settled by a civil court with the Stockholm District Court as the court of first instance.

  1. CHANGES TO TERMS AND CONDITIONS

15.1 WallRibbon reserves the right to make changes to these terms and conditions at any time. If WallRibbon makes any changes to these terms and conditions, we will notify you by posting the changes on the website. Changes to the terms and conditions apply from the time when you accept the terms and conditions (at the time of purchase or visit to the website), or 30 days after we have informed you of the changes. WallRibbon recommends that you regularly check the website in order to be aware of any changes to the terms and conditions.

  1. NULLITY

16.1 If the competent court, authority or arbitration panel determines that any provision of these terms and conditions is null or unenforceable, that provision, and all other provisions, shall remain valid and enforceable to the extent permitted by applicable law. The provisions that are declared null or unenforceable will be replaced by relevant legal guidance and advice.
